1. Acceptance of Terms

By downloading, installing, or using the Betting Tips mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). These Terms form a legally binding agreement between you and the App’s owner, Yuliya Yukhnevich, an individual residing in Cyprus, European Union (referred to as “we”, “us”, or “our”). If you do not agree with these Terms, you must not use the App.

You acknowledge that you have also read and understood our Privacy Policy and Disclaimer, which are incorporated by reference into these Terms. These documents describe how we handle your data and provide important information about using the App.

2. Eligibility and Age Restriction

The App is intended for use by adults only. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to download or use the App. By using the App, you represent and warrant that you are 18 or older and legally capable of entering into this agreement. The App is not directed at children or anyone under 18. If we become aware that a person under 18 is using the App, we reserve the right to terminate their access.

It is also your responsibility to ensure that using the App and viewing sports betting tips is legal in your jurisdiction. You agree to comply with all applicable laws and regulations when using the App, including laws related to gambling, data usage, and intellectual property.

3. Description of the Service

Betting Tips is a mobile application that provides football (soccer) match predictions, analysis, and tips for informational and entertainment purposes. The App may display team names, league names, logos, match details, and other related information, which are obtained through third-party data providers (e.g., via RapidAPI). No real-money betting or gambling is offered within the App. The App does not enable placing bets, wagering money, or any form of gambling transactions. There are no prizes or monetary rewards in this App.

All predictions and tips provided in the App are the opinions of the App’s creators or its algorithms. While we strive to offer accurate and well-informed predictions, no prediction is guaranteed. The outcomes of sporting events are uncertain by nature, and past performance is not indicative of future results. Users should treat the content as one source of information and not as a guarantee of any particular outcome.

4. Proper Use of the App

You agree to use the App in a responsible and lawful manner. You must not:

• Use the App for any unlawful purpose, including but not limited to illegal gambling, fraud, or activities that violate sports integrity or betting laws in your region.
• Attempt to hack, disrupt, cheat, or modify the App, or interfere with other users’ access to the App.
• Use any automated system (such as bots or scrapers) to access, extract data from, or otherwise interact with the App without our prior written permission.
• Reproduce, duplicate, copy, sell, trade, or resell the App’s content or software for any commercial purpose without authorization.

Violation of the above rules or any other aspect of these Terms may result in immediate termination of your right to use the App (see Termination below), and may also expose you to legal consequences.

5. Third-Party Content and Trademarks

The App uses data and content provided by third parties. This includes, for example, the names of football teams, league names, tournament names, logos, and other related information, which may be retrieved via a third-party API service (such as RapidAPI). All such third-party names, logos, and trademarks are the property of their respective owners. They are used in the App solely for identification, informational, and referential purposes in the context of the predictions. We acknowledge the intellectual property rights of those third parties and do not claim any ownership over these names and logos.

Your use of the App does not grant you any rights to those third-party trademarks or intellectual property. You agree not to use any team names, league names, logos, or other trademarks displayed in the App in any way outside the App that could infringe the rights of the owners.

We also rely on third-party services for data and functionality (for example, data feeds, cloud services, or push notification services). While we strive to choose reliable providers, we do not guarantee the availability, accuracy, or completeness of any third-party content or service. We are not responsible for any errors or delays in information provided by such third parties.

The App may occasionally include links or references to external websites or services (such as sports news or official league sites). These links are provided for convenience and additional information. We do not endorse and are not responsible for the content, products, or services on any third-party websites. If you click on external links, you do so at your own risk, and separate terms and privacy policies of those external sites may apply.

6. Intellectual Property Rights

Except for third-party content discussed above, all other content, features, and materials in the App are owned by or licensed to us. This includes (but is not limited to) the App’s software code, design, layout, the name and logo of Betting Tips, original text, predictions data compiled by us, and any original graphics or images provided through the App. These are protected by copyright, database rights, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and view its content for your personal, non-commercial use, in accordance with these Terms. You may not duplicate, distribute, modify, publish, transmit, create derivative works from, or exploit our content or the App’s software without our express prior written consent.

You also agree not to remove, obscure, or alter any copyright, trademark, or other proprietary rights notices displayed in the App. The name “Betting Tips” and our branding are our trademarks or service marks. You are not granted any license or right to use them outside of using the App, except with our permission.

7. Unofficial Product (No Affiliation)

The Betting Tips App is an unofficial application for sports predictions. We are not affiliated with, endorsed by, or associated with any official football clubs, leagues, tournaments, or sports organizations. This includes (but is not limited to) organizations such as FIFA, UEFA, any national football associations, or any professional leagues (e.g., English Premier League, La Liga, Bundesliga, etc.). All team and league names or images that may appear in the App remain the trademarks and intellectual property of their respective owners, and their appearance in the App does not imply any relationship, sponsorship, or endorsement by those entities.

Similarly, the App and its owner are not affiliated with any betting or gambling company. Any mention of odds, betting terminology, or tips is purely for informational context and does not constitute an endorsement of any betting platform.

8. Apple App Store and Third-Party Platforms

This Terms of Service agreement is solely between you and us (the App provider), not with any third-party platform provider. If you downloaded the App from the Apple App Store, you acknowledge that:

• Apple Inc. is not a party to these Terms and is not responsible for the App or its content. We, as the developer, are solely responsible for providing any maintenance or support services for the App, and Apple has no obligation to furnish any such services.
• In the event of any failure of the App to conform to any applicable warranty (express or implied), you may notify Apple, and Apple may refund the purchase price (if any) of the App to you. Except for that, to the maximum extent permitted by law, Apple will have no other warranty obligation or liability whatsoever with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; or (iii) claims arising under consumer protection or similar legislation.
• Apple and Apple’s subsidiaries shall be considered third-party beneficiaries of these Terms. This means that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

We also note that Apple, the Apple logo, iPhone, and iPad are trademarks of Apple Inc., registered in the U.S. and other countries. Apple is not a sponsor of, or in any way affiliated with, the Betting Tips app or any content or activities within the app.

If you downloaded the App from any other platform or app store (such as Google Play for Android), similar provisions apply: the platform provider (e.g., Google) is not responsible for the App, is not a party to these Terms, and is released from any liability or obligations related to the App. You must also comply with all applicable third-party platform terms of service when using the App.

9. Disclaimer of Warranties

The App and all content within it are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties and representations of any kind, whether express, implied, or statutory, regarding the App. This includes, but is not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Any warranty that the App will be uninterrupted, error-free, or secure.
• Any warranty that the information (including match predictions, statistics, or other data) is completely accurate, reliable, or up-to-date.

While we endeavor to provide useful and accurate information, we do not guarantee the correctness or accuracy of any predictions or data presented. Sports outcomes are uncertain, and the information in the App may contain errors or omissions. You understand that using the App is at your own discretion and risk. You should not rely solely on the App’s content for making important decisions (such as placing bets or wagers). We make no guarantee that using the information from the App will improve your betting results or lead to any particular outcome.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we (the App owner/developer) be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of (or inability to use) the App or its content. This includes, but is not limited to, any loss of profits, loss of data, loss of goodwill, or any financial losses incurred as a result of sports betting or other activities you undertake in reliance on the App’s information.

You agree that if you choose to use information from the App to engage in sports betting or any other activity, you do so at your own risk. We will not be responsible for any monetary losses or damages you may suffer in connection with such activities. Under no circumstances will we be obligated to reimburse or indemnify you for any losses resulting from use of the App.

Our total cumulative liability to you for any and all claims related to the App is limited to the amount (if any) that you paid to download or use the App. In many cases, this amount will be zero (if the App is provided for free). Some jurisdictions do not allow the exclusion or limitation of certain liabilities; in such cases, our liability will be limited to the minimum extent permissible by law.

Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under applicable law (for example, certain liabilities under EU law for personal injury or fraud).

11. Indemnification

You agree to indemnify, defend, and hold harmless the App owner ([Name]) and any associated parties (including any officers, agents, partners, or contributors) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) that arise from or relate to:

• Your use or misuse of the App,
• Your violation of these Terms, or
• Your violation of any law or regulation or the rights of any third party in connection with your use of the App.

This means that if a third party (for example, a sports league, another user, or a government authority) brings a claim against us due to your actions (such as misuse of third-party content, illegal use of the App, or other violations), you will be responsible for all costs and damages we incur as a result of that claim. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we otherwise decide to discontinue the App. Upon termination, your rights to use the App will immediately cease.

You may also stop using the App and uninstall it at any time if you no longer agree to these Terms. If you have created any user account or profile within the App (if such functionality exists), you may delete your account or request us to delete it.

Sections of these Terms which by their nature should survive termination (such as Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to remain in effect after your use of the App has ended.

13. Changes to These Terms

We may occasionally update or modify these Terms of Service. If we make material changes, we will notify users by posting the updated Terms in the App and updating the “Last updated” date at the top, or by other appropriate means. It is your responsibility to review the Terms periodically.

By continuing to use the App after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new Terms, you must stop using the App.

14. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Republic of Cyprus, along with applicable laws of the European Union. This choice of law is made because the App owner resides in Cyprus. However, this does not deprive you of any protection you are entitled to under the mandatory consumer protection laws of your own country of residence.

If you are a consumer in the European Union, you may also have rights under your local consumer protection or data protection laws. These Terms will be interpreted in a manner consistent with such laws, and nothing in these Terms will limit your rights under those laws.

In the event of any dispute or claim arising out of or relating to the App or these Terms, the courts of Cyprus shall have jurisdiction, unless applicable law in your country of residence requires that disputes be resolved in that jurisdiction. We encourage you to contact us first to seek an amicable resolution to any issue.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of the Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Entire Agreement

These Terms of Service, together with the Privacy Policy and Disclaimer for the Betting Tips app, constitute the entire agreement between you and us regarding your use of the App. They supersede any prior agreements or communications between you and us relating to the App.
